GENERAL TERMS AND CONDITION

At Hyundai Autoever Inc. (“Autoever", "we", "us" or "our"), we recognize the importance of your privacy and appreciate that your personal information is very important to you. Where applicable, Autoever will handle personal information relying on the related bodies’ corporate exemption and the employee records exemption in the Privacy Act and any other applicable exemptions in the Privacy Act or other legislation.

In this Privacy Policy "personal information" has the meaning set out in the Privacy Act.

Basically, personal information is information or an opinion about an individual who is reasonably identifiable.

This Privacy Policy sets out key information regarding our collection, use, disclosure and storage of your personal information, and of your ability to access and correct it. We may amend this Privacy Policy at any time, at our discretion and without notice to you.

In this Privacy Policy "personal information" has the meaning set out in the Privacy Act.

Types of Personal Information

The type of personal information Autoevercollects from or about you and holds depends on the circumstances in which the information is collected.

We mainly collect information about your contact details (including your name, address, email address, phone and mobile numbers).
We may collect information about your Hyundai vehicle, including its number plate and vehicle identification number (VIN).
The type of personal information we collect on our website depends on how you use our website.

If you merely visit and browse through our website, we will not collect any personal information unless you make an enquiry about a Hyundai product or service.

However, upon your visit to our website our host may record your server IP address, domain name, the date and time of your visit and the pages viewed. This information may be collected using cookies. User preferences are stored in cookies, which track user trends and patterns of use, and allow our website to interact more efficiently with your computer. You can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you disable the use of cookies, your use of our website may not function optimally.

If you are employed by a Hyundai dealer, personal information we collect may include your name, position and contact details

How Autoever collects your personal Information?

Autoever may collect personal information from or about you in a variety of ways. The most common ways we collect personal information are:

we will collect or receive your personal information from an Hyundai if you purchase a new or used Hyundai vehicle, part or accessory from an authorized Hyundai dealer, and/or arrange finance for the purchase of your Hyundai vehicle, or take a test drive at an authorized Hyundai dealer;
if you are employed by or contracted to an authorized Hyundai dealer, directly from you or from that dealer;

The Purposes for which Autoever collects, holds uses and disclose personal information

The purposes for which we collect, hold, use and disclose your personal information will depend on the circumstances for which we collect it. In general, we may use and disclose your personal information for the purposes for which we collect it and related purposes which you would reasonably expect, for purposes which you consent, and as otherwise authorized or required by law.

Consequences if you don’t provide your personal information?

If we are unable to collect personal information we require, we may not be able to do business with you or the organization with which you are connected, or advise you of information in relation to Hyundai vehicles, parts, accessories or Hyundai services or offers.

For example, if we did not collect personal information about your new vehicle purchase, we would be unable to remind you directly of a service that is due, or notify you of a field service action for the vehicle.

Return Policy

Once an authentication code has been generated for a download, there are no returns. If you are having issues with the software, please contact the customer center. (0888-770-3355)

Force Majeure

Force majeure means circumstances that impede the fulfillment of Hyundai AutoeverInc.’s obligations under these Terms and Conditions which are not within Hyundai Autoever Inc.’s reasonable control. In a force majeure situation all of Hyundai Autoever Inc.’s obligations shall be suspended. Should the period in which Hyundai AutoeverInc. cannot fulfill its obligations as a result of force majeure for longer than ninety (90) calendar days, both parties shall be entitled to dissolve the purchase agreement in writing without there being an obligation to pay any compensation whatsoever arising out of or in connection with that dissolution.

Limited Warranty

a) Hyundai Autoever Inc.does not and cannot warrant that the Map Updates operate in a manner that is completely error-free, and that any information provided is always accurate.
b) EXCEPT FOR THIS LIMITED WARRANTY, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICALBE LAW, HYUNDAI AUTOEVER AND ITS SUPPLIERS PROVIDE THE MAP UPDATES “AS IS AND WITH ALL FAULTS”, AND HEREBY DSICLAIM ALL OTHER WARRANTIES AND CONDITIONS. WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO, ANY (IF ANY) IMPLIED WARRANTIES, DUTIES OR CONDITIONS OF MERCHANTABILITY OR AVAILABILITY, OF ACCURACY OR COMPLETENESS OF RESPONSES, OF RESULTS, OF WORKMANLIKE EFFORT, AND OF REASONABLE CARE AND SKILL, ALL WITH REGARD TO THE MAP UPDATES, AND THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT OR OTHER SERVICES, INFORMATION, SOFTWARE AND RELATED MAP UPDATE MEDIA THROUGH THE MAP UPDATES OR OTHERWISE ARISING OUT OF THE USE OF THE MAP UPDATES. ALSO, THERE IS NO WARRANTY OR CONDITION OF QUIET ENJOYMENT, QUIET POSSESSION, OR NON-INFRINGEMENT WITH REGARD TO THE MAP UPDATES.
c) In order to make a claim under the Limited Warranty of a Defect, you must contact Hyundai Autoever Inc. by email during the Warranty Period by calling customer support 0888-770-3355 to explain the Defect if necessary, along with an explanation of the Defect, to the address provided by Hyundai Autoever Inc.. You must comply with any other return policy stipulated by Hyundai AutoeverInc., if any.
d) This Limited Warranty is the only express warranty made to you and is provided in place of any other express warranties or similar obligations (if any) created by any advertising, documentation, packaging, or other communications.
e) This Limited Warranty is not transferable.
f) This article sets forth your sole and exclusive remedy in connection with any warranties granted by Hyundai Autoever Inc. hereunder.

Some jurisdiction do not allow limitations on how long an implied warranty lasts and/or do not allow the exclusion or limitation of incidental or consequential results, so the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights, and you many also have other rights which vary from jurisdiction to jurisdiction.

Disclaimer of Liability

Hyundai Autoever Inc. and its licensors (including their licensors and suppliers) shall not be liable to you; in respect of any claim, demand or action, irrespective of the nature of the cause of the claim, demand or action alleging any loss, injury or damagers, direct or indirect, which may result from the use or possession of the information; or for any loss of profit, revenue, contracts or saving, or any other direct, indirect, incidental, special or consequential damages arising out of your use of or inability to use this information, any defect in the information, or the breach of these terms or conditions, whether in an action in contract or tort or based on warranty, even if Hyundai Autoever Inc.or its licensors have been advised of the possibility of such damages. Some States, Territories and Countries do not allow certain liability exclusion or damages limitations, so to that extent the above many not apply to you.
